A new law on gardening and horticulture for one’s own requirements comes into effect in 2019

From January 1, 2019, new Federal law № 217-ФЗ «About gardening and horticulture for one’s own requirements and about adjustments in some legislative acts of the Russian Federation” comes into effect. The draft law has already been signed by the President of the Russian Federation V. Putin. According to the draft law, dachas are eliminated as a kind of economic activity and 2 legal structures will be used instead for gardening and horticulture: horticultural non-profit cooperation and gardening non-profit cooperation.

One will be able to build dwelling houses on horticultural plots while owners of garnering plots will be able to have light constructions.

Unified principles of contribution accounting in partnerships will be introduced and the ways to spend the money contributed will be defined. Beside this, administrative bodies will be established in partnerships, and legal relations concerning communal facilities will be outlined.

The law also fixes the uniform procedure of granting of state and municipal lands for use.

There will be also transitional period provisions to regulate relations, which already exist in the sphere of gardening, horticulture and dacha activities. Namely, it is stated that constitutional documents and names of non-commercial organizations for gardening, horticulture and dacha activities, which have been already created by citizens, are subject to bring into conformity with the requirements of the Federal law at the 1st constitutional document change of such organizations.
